Leeman Earthworks (ABN 20 652 906 431) ("we", "us", "our") provides earthworks, excavation, concrete retaining walls, landscaping and site works. We are committed to protecting your privacy and to handling your personal information in line with the Privacy Act 1988 (Cth) and the 13 Australian Privacy Principles (APPs).

This policy explains what personal information we collect, why we collect it, how we use and disclose it, how we keep it secure, and how you can access it, correct it or make a complaint. It applies to information we collect through our website at https://leeman.au/, by phone, by email or SMS, on site, and through our quoting, scheduling and accounts systems.

By providing us with your personal information, or by enquiring about or engaging our services, you agree to your information being handled as set out in this policy.

1. About this policy and the Privacy Act

The Privacy Act 1988 (Cth) and the APPs set the standard for how personal information is collected, used, disclosed, stored and accessed in Australia. We handle your personal information in accordance with these obligations. The Office of the Australian Information Commissioner (OAIC) oversees the Privacy Act and the APPs.

We review this policy from time to time and may update it to reflect changes in our practices or the law. The current version is always the one published at https://leeman.au/, and the date at the top shows when it was last updated.

2. What personal information we collect

Personal information is information or an opinion about an identified individual, or an individual who is reasonably identifiable. The kinds of personal information we collect depend on how you deal with us, and may include:

• Identity and contact details: your name, the name of your business or household contact, email address, phone number and postal address.
• Job and site information: the address and details of the site where work is to be carried out, site access arrangements, the nature of the work you need, plans, measurements, photographs and any site conditions you tell us about.
• Quoting and account information: the details you give us when you request a quote, accept a quote, book a job, or are invoiced, including any pricing, variation and payment records.
• Payment information: billing details and records of payments. Where card or direct payments are processed, this is handled by our payment provider and we do not store full card numbers.
• Communications: records of your enquiries, quotes, instructions, correspondence, SMS and call notes.
• Website and technical information: when you use https://leeman.au/, we may collect your IP address, device and browser type, the pages you view, the date and time of access, and similar analytics data, including through cookies and similar technologies.
• Marketing preferences: whether you have opted in to receive updates and offers, and any opt-outs you make.

We generally do not collect sensitive information (such as health information). If we ever need to, we will only collect it with your consent or where we are permitted to by law.

3. How we collect your personal information

Where it is reasonable and practicable, we collect personal information directly from you: when you contact us, request or accept a quote, book a job, give us access to your site, pay an invoice, or use our website.

Sometimes we collect information about you from third parties, for example a referrer who recommends our services, a head contractor or builder you are working with, a real estate agent or property owner, or publicly available sources. If we collect your information from someone else, we take reasonable steps to make sure you are aware of this policy and of how we handle your information.

If you do not provide the information we ask for, we may not be able to give you an accurate quote, schedule or carry out your job, or otherwise provide our services.

4. Why we collect, hold, use and disclose your information

We collect, hold and use your personal information for purposes connected with our business, including to:

• respond to your enquiries and prepare and provide quotes;
• schedule, plan, carry out and complete your earthworks, excavation, retaining wall, landscaping or site works job;
• manage site access, variations, materials and subcontracting;
• send you job updates, scheduling messages and reminders relating to work you have engaged us for;
• raise invoices, process payments and manage our accounts and records;
• meet our legal, insurance and work health and safety obligations;
• handle complaints, warranty matters and disputes;
• improve our website and services; and
• where you have opted in, send you marketing about our services (see section 6).

We will only use or disclose your personal information for the purpose we collected it, for a directly related purpose you would reasonably expect, or where you have consented, or where we are otherwise permitted or required to by law.

5. Who we disclose your information to

We disclose personal information only as needed to run our business and deliver your job. This may include disclosure to:

• our employees, contractors and subcontractors who are involved in quoting, scheduling or carrying out your work;
• our service providers, including customer relationship management (CRM), scheduling, hosting, analytics, email and SMS, accounting and payment providers, who are bound to protect your information and use it only for the services they provide to us;
• other parties involved in your project where reasonably necessary, such as a head contractor, builder, property owner or other trades, where you have asked us to coordinate with them;
• our professional advisers, such as accountants, insurers and lawyers; and
• government bodies, regulators or others where we are required or authorised by law, or to protect our legal rights.

We do not sell your personal information.

6. Direct marketing (APP 7)

We may use your personal information to send you marketing about our services, such as updates, seasonal offers and reminders, where you have opted in or where you would reasonably expect us to and the law allows it.

Every marketing message we send will identify us and include a simple way to opt out. You can ask us to stop sending you marketing at any time by using the unsubscribe option in the message, replying to ask us to stop, or contacting us using the details in section 12. We will action your request promptly. Our electronic marketing is also handled in line with the Spam Act 2003 (Cth) (see section 7).

Service messages about a job you have engaged us for, such as scheduling, access and completion updates, are not marketing and will continue while we are working with you.

7. Electronic messaging and the Spam Act 2003 (Cth)

Where we send commercial electronic messages by email or SMS, we comply with the Spam Act 2003 (Cth), which is administered by the Australian Communications and Media Authority (ACMA). This means we will:

• only send commercial electronic messages with your express or inferred consent;
• identify ourselves as the sender and include our contact details; and
• include a functioning unsubscribe facility in each commercial message, and honour unsubscribe requests promptly.

8. Cookies and website analytics

Our website may use cookies and similar technologies to help the site work, remember your preferences and understand how the site is used. You can set your browser to refuse cookies or to alert you when cookies are being used, although some parts of the site may not function properly if you do. We may use analytics tools that collect aggregated, non-identifying information about site usage.

9. Storage, security and overseas disclosure (APP 8 and APP 11)

We take reasonable steps to protect your personal information from misuse, interference and loss, and from unauthorised access, modification or disclosure. These steps include access controls, use of reputable service providers, and secure handling of records. When we no longer need your personal information for any purpose for which it may be used or disclosed, and we are not required by law to retain it, we will take reasonable steps to destroy or de-identify it.

Some of our service providers (for example, cloud hosting, CRM, email and SMS platforms) may store or process information outside Australia. Where we disclose personal information overseas, we take reasonable steps to ensure the recipient handles it in a way consistent with the APPs, as required by APP 8.

10. Notifiable Data Breaches scheme

We are committed to handling personal information securely. If we experience a data breach that is likely to result in serious harm to individuals whose personal information we hold, and we are unable to prevent that likely harm through remedial action, we will respond in line with the Notifiable Data Breaches (NDB) scheme under Part IIIC of the Privacy Act 1988 (Cth). This includes assessing suspected eligible data breaches, generally within 30 days, and, where required, notifying affected individuals and the OAIC.

11. Access and correction (APP 12 and APP 13)

You can ask us for access to the personal information we hold about you, and ask us to correct it if it is inaccurate, out of date, incomplete, irrelevant or misleading. Contact us using the details in section 12. We will respond within a reasonable time. In most cases there is no charge to access your information, although we may pass on reasonable costs in some circumstances. If we refuse access or a correction, we will tell you why in writing where required, and explain how you can complain.
